1. Use of Our Services

1.1 Eligibility

You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

1.2 Account Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.

You are responsible for safeguarding the password that you use to access our services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

1.3 Acceptable Use

You agree not to use our services:

• In any way that violates any applicable national or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," or "spam" or any other similar solicitation.

• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of our services, or which may harm our company or users of our services.

2. Booking and Cancellation Policies

2.1 Booking Confirmation

All bookings are subject to availability and confirmation. A booking is not confirmed until you receive a written confirmation from us and full payment has been processed.

2.2 Pricing and Payment

All prices are quoted in Canadian dollars (CAD) unless otherwise stated. Prices are subject to change until your booking is confirmed. We accept various payment methods as indicated during the booking process.

You agree to pay all charges incurred by you or any users of your account and payment method at the prices in effect when such charges are incurred.

2.3 Cancellation Policy

Our cancellation policy varies depending on the type of service booked and is detailed at the time of booking. Generally:

• Cancellations made 60+ days before the start date: Full refund minus administrative fee
• Cancellations made 30-59 days before the start date: 50% refund
• Cancellations made 0-29 days before the start date: No refund

We strongly recommend purchasing travel insurance to protect against unforeseen circumstances.

2.4 Changes to Bookings

If you wish to change any part of your booking after confirmation, we will do our best to accommodate your request but cannot guarantee that changes will be possible. Any change may be subject to availability and additional costs.

3. Intellectual Property

Our website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Tyaguchaya Repa, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use our website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
• If we provide social media features with certain content, you may take such actions as are enabled by such features.

4. Travel Requirements and Responsibilities

4.1 Travel Documentation

You are responsible for obtaining and maintaining all necessary travel documents, including valid passports, visas, health requirements, and insurance. We are not responsible for any consequences resulting from your failure to obtain or carry the correct documentation.

4.2 Travel Insurance

We strongly recommend that all travelers purchase comprehensive travel insurance to cover trip cancellation, medical emergencies, personal accidents, and loss of personal property during your trip.

4.3 Health and Safety

Travelers are responsible for assessing their own health and fitness to participate in activities booked through our services. Some activities may have physical demands or take place in locations with limited medical facilities. You must inform us of any medical conditions, disabilities, or special needs that may affect your participation in booked activities.

5. Limitation of Liability

To the maximum extent permitted by law, in no event shall Tyaguchaya Repa, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our services;
• Any conduct or content of any third party on our services;
• Any content obtained from our services; and
• Unauthorized access, use or alteration of your transmissions or content.

Our total liability to you for all claims arising from or related to the services shall be limited to the amount you have paid to us for services within the twelve (12) month period prior to the event giving rise to the liability, or CAD$100 if no such payment has been made.

6. Indemnification

You agree to defend, indemnify, and hold harmless Tyaguchaya Repa, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

7. Third-Party Links

Our services may contain links to third-party websites or services that are not owned or controlled by Tyaguchaya Repa. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

8. Termination

We may terminate or suspend your account and bar access to our services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our services.
